Firm History
Clark and Clark, LLC was founded in 2007 as a criminal defense firm. Both founding partners were prosecutors since the early 1990's and were in charge of major criminal investigative units before starting Clark and Clark in 2007. Our firm exclusively practices criminal law. Unlike many other firms, we do not spend our time practicing any other type of law.We have used our years of experience as prosecutors to perfect our trial skills and, as a result, we have developed a unique expertise in criminal law.

Activities and Awards
Founding partner Charles Clark has been Certified by the Supreme Court of New Jersey as a Criminal Trial Attorney. There are over 70,000 licensed lawyers in the State of New Jersey but, as of 2009, there are only 258 that have met the rigorous requirements set up by the New Jersey Supreme Court to become certified criminal trial attorneys.

What is your firm's point of view regarding clients educating themselves on legal issues?:
Our firm is never opposed to a client educating himself or herself on a legal issue. Clients charged with a crime often conduct their own research. Unlike many other criminal defense lawyers, I encourage a client to research legal issues if it makes him feel more comfortable about the criminal justice process. In many cases, the client can get a better sense of his lawyer's experience and knowledge when the lawyer repeats something the client has already discovered during his own research.
Are your attorneys willing to review documents prepared by clients?:
Obviously, our firm would review any document prepared by our clients. Most of our criminal clients do not prepare documents nor do they know where to begin when addressing a complex criminal matter. Of course, we would always encourage clients to research or prepare any documents that would make them feel more comfortable with the criminal justice process.
Are your attorneys willing to coach clients who want to represent themselves?:
Clients have an absolute right to represent themselves pro se. We would gladly stand by and assist any client who felt the need to represent himself or herself. The better practice, however, would be for the client to allow his lawyer to advocate on his behalf. The client is always encouraged to ask questions and assist during the pre-trial and trial phase of his case.
Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?:
As with many law firms, we are not always the first lawyer to handle a client's case. We often receive cases after they have been tried for purposes of the appeal. Of course, we are highly trained and experienced criminal trial lawyers. We, therefore, would prefer to get into a case from the beginning whenever possible but can assist clients with just one discrete part of a case.
What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?:
Clark and Clark, LLC consists of two equally qualified criminal trial attorneys. The benefit to our clients is that they are never dealing with an associate who may or may not know a specific answer or even be qualified to handle a certain case. Based on our experience, we rarely need the assistance of a paralegal or another attorney to write a legal brief or handle a particular matter. The benefit to our clients is that the fee paid to our lawyers is usually the only fee they are going to incur.
How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?:
Criminal law involves plea negotiations between the defense attorney and the prosecutor. Our attorneys are always cognizant of the plea offer our clients receive from the Prosecutor and have the experience to know when an offer is fair and when it should be rejected in favor of a trial.
Does your firm provide pro bono legal services or otherwise participate in your community?:
All firms in New Jersey are assigned annual pro bono legal cases and our firm is no exception.
What distinguishes your law firm from others?:
Our criminal defense law firm offers three distinct advantages over other law firms.
- Both of our attorneys were not just prosecutors but senior prosecutors in charge of major criminal units and cases. We have an understanding of the inner workings of a prosecutors office and the factors that influence a prosecutor's decision in negotiating or trying a case. This information is invaluable in advocating on behalf of our clients.
- Unlike many other criminal defense lawyers, our attorneys have real jury trial experience. We spent many years trying complex criminal cases for every type of criminal offense. We do not worry about being taking advantage of in plea negotiations because we have the confidence to go to trial on any case. We stress to our clients that our firm takes a trial posture on every case. We do not go to trial on every case and are often successful in our plea negotiations. But our clients do have all of the options available to them and can feel confident that they will have an excellent chance of success if they choose to go to trial.
- Finally, we exclusively practice criminal law. The value of this point cannot be overstated. We have spent year after year immersed in the practice of criminal law. Unlike many of our colleagues, we have not been distracted with cases involving other areas of practice such as Family law or Personal Injury Law. If a legal issue arises in a criminal case, chances are we have seen it many times before and are already familiar with the issue and the argument.
