David M. McLain is a founding member of Higgins, Hopkins, McLain & Roswell, LLC, a firm which specializes in construction defect and general civil litigation throughout Colorado.  Mr. McLain received his undergraduate degree from Colorado State University, graduating cum laude, and his law degree from the University of Denver, College of Law.  He has a general civil litigation practice with an emphasis on the defense of complex construction lawsuits on behalf of developers and general contractors.  As a result of the experience gained by defending some of Colorado’s largest residential construction defect lawsuits, developers, general contractors, and subcontractors seek out Mr. McLain to consult on risk avoidance and risk management strategies.  Currently among his clients are several of the state’s largest homebuilders, regional and custom builders, a Fortune 200 company, and numerous insurance carriers.  Mr. McLain is an AV® Preeminent™ Peer Review Rated attorney by Martindale-Hubbell and is a regular speaker at seminars regarding construction defect litigation in Colorado.  In addition, he is proud to serve as an instructor for the Home Builders Association of Metropolitan Denver’s Quality Construction Certification program.

What is your firm's point of view regarding clients educating themselves on legal issues?:

We encourage our clients to educate themselves regarding the law pertaining to construction litigation in Colorado. To that end, we have begun writing our own blog on the topic called Colorado Construction Litigation.

Yes, depending on the circumstances.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?:

We strive to have all work completed by the attorney or paralegal in a cost-effective manner. When possible, we have the work completed by the individual who has the lowest billing rate, but still the ability to provide excellent results.



How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?:

We typically arbitrate all cases we can get into that forum.  Regardless of whether a case is in arbitration or litigation, all cases will be mediated before the arbitration hearing or trial.



Does your firm provide pro bono legal services or otherwise participate in your community?:

Yes.  In addition to providing pro bono legal services, we spend one day per year working together on a Habitat for Humanity job site.



What distinguishes your law firm from others?:

There are many general practice or insurance defense law firms that offer construction litigation as part of their practice, but HHMR is one of the few that specializes in construction law and the litigation of construction claims.
